Key legal basis for claims

Breach of Contract & Consumer Obligations

  • Under the Australian Consumer Law, services must be provided with due care and skill and achieve the expected result. Passengers may seek redress if an airline fails to fulfil these requirements regarding baggage compensation.

International Conventions

  • The Montreal Convention governs international travel, setting out an airline’s liability for lost, delayed, or damaged baggage. Airlines must compensate passengers to the extent of their loss subject to an upper limit of AUD$3,208.

Example of Alleged Conduct

A passenger’s checked bag failed to arrive after a domestic flight. Despite the airline’s assurances, the passenger waited 5 days for its return and had to purchase clothing, toiletries, and essential medication in a remote area.

The airline refused to refund most expenses and ignored the fact that the first few days of the passenger’s holiday was ruined.
